Terms & Conditions of Charter

The following sets out the terms and conditions under which ‘Hebrides Fish ‘n’ Trips’ (the vessel) may be chartered. This document forms an agreement between the owner of Hebrides Fish ‘n’ Trips (the owner) and the individual or group of individuals hiring the vessel for a private charter (the customer).

The owner will make available the vessel, licensed, insured and carrying regulation safety equipment as set out in the MCA Code of Practice for Small Commercial Vessels. The vessel will be skippered by a licensed individual.

Payment in cash of the full charter fee will be made to the owner at the time of departure of charter by the customer.

If the owner cancels the charter prior to its set departure time due to adverse weather conditions, illness, breakdowns or other force majeure, the owner will not be liable for any loss incurred by the customer. In the event of any early return to port due to deteriorating weather only the portion of the charter spent at sea is chargeable and a refund will be given on the balance of the charter fee. In the event of an early return to port at the insistence of the customer, no refund will be given.

The owner will not be liable for the loss or damage to any article of personal property belonging to the customer which may occur during the charter or when the customer is embarking or disembarking from the vessel.  

The owner will not be liable for the personal injury or death of the customer when aboard the vessel except where it results from a negligent act or omission by the owner. The owner will not be liable for any personal injury or death of the customer when embarking or disembarking from the vessel.

Vehicles are parked at embarkation points at the customers risk. 

The owner reserves the right to make charges (to the full cost) for repair or replacement of any item aboard the vessel damaged or broken by the customer. 

If during a charter, in the opinion of the owner, the customer places the boat, the boat equipment or its occupants at risk, in whatever manner, the owner reserves the right to terminate the charter immediately.  No refund will be given.

The customer must act on the instructions of the owner at all times. 

The owner operates a NO SMOKING and NO ALCOHOL and NO PROHIBITED DRUGS policy on the vessel.

The owner reserves the right to change prices and booking conditions at any time.

The owner will only use any individual information obtained from the customer lawfully in accordance with the Data Protection Act 1998.

Any legal action or proceedings arising out of or connected with this agreement shall be governed by the Laws of Scotland.
